Is there some sort of government regulation to around 38hp from the factory? It seems like that is the magic number from all the factories.

No. But like these guys said all the stockers seem to be same hp wise. My 06 yfz was same as this new one til pipe, intake, cam mod and major jetting 48hp. My Dreamrides YFZ got same thing with different pipe. I dont remember it falling off as early as the 09 though. Maybe they are killing timing like on Raptor.

Here's the chart for my 06 yfz with only slip-on and the lid removed with stock filter setup (no cam mod or aftermarket intake), but obviously rejetted
